Prop Firms Without a Consistency Rule: We Read the Rulebooks.

Some prop firms genuinely publish no consistency rule — but the question hides three qualifiers most lists skip: which product, which stage, which payout path. The same brand can be rule-free in the challenge and capped at the payout desk. Here's what ten firms' own rulebooks say, quoted and linked, checked on one date — plus the five-minute check that beats any list, including this one.

You passed the challenge on one great day.

The dashboard says funded. Weeks later, the payout button is greyed out — and the support article it links to mentions a rule the challenge page never did.

Nothing was hidden, exactly. It just wasn't where you were looking.

The short answer

Prop firms without a consistency rule exist, and several are listed below with their own pages as receipts. But the honest version of the answer needs three qualifiers that "top 10" lists skip: which product (the same brand often runs CFD and futures lines under different rules), which stage (many rules skip the challenge entirely and bite at the payout request), and which payout path (some caps exist only on specific plans or reward options).

Everything below is quoted from each firm's own published rules and help pages, checked on 2026-07-24. Firms change rules without notice, so treat this as a dated snapshot with sources, and run the five-minute check at the end before paying anyone, including on anything we say here. Read the pattern before celebrating: all seven of those rows are rule-free in one stage or product line of a firm that enforces a cap somewhere else in the next table.

Where the rule applies — and where it bites

Same date, same sourcing. "Soft" means exceeding the cap doesn't fail the account; you keep trading until the ratio complies.

One naming trap while you compare: TradeDay and Tradeify are different firms with different rules — search results for this exact question mix them constantly.

The three patterns in the fine print

The rule lives at the payout desk more than in the challenge. Apex, Topstep's Express path, FundedNext's CFD funded stage, Maven, E8's Performance stage, FundingPips Zero — the cap gates getting paid, not passing. Searching "firms without a consistency rule," most people are vetting the wrong stage.

One brand, several rulebooks. FTMO's 2-Step has no cap while its 1-Step does. The5ers' forex line has none while its futures line runs 40% per trade. FundedNext splits CFD from futures, then splits futures by challenge type. A list that prints one number per brand is wrong somewhere by construction.

Most caps are soft — which is honest, and still costs you. "Keep trading until the ratio complies" sounds gentle. A soft cap doesn't take your account; it takes your time — profitable days you must add before your own money moves. That waiting period is where oversized-day habits get expensive, and it's measurable in advance: the calculator shows exactly how many ordinary days one big day costs under any cap.

The five-minute check that beats any list

Minute 1 — Find the actual rulebook, not the pricing page: help center, FAQ, or challenge terms. Minutes 2–3 — Search the page for "consistency," then read the payout and withdrawal articles even if the challenge page came up clean; you now know why. Minute 4 — Note the denominator: of total profit, of the profit target, per day or per trade. They produce very different limits. Minute 5 — Run your plan through the consistency calculator with the cap you found. If your normal best day trips it, you want to know on minute five, not at the payout desk.

Where we sit

Rules change, sometimes for existing accounts — several rulebooks explicitly reserve that right — so the only version that binds you is the one on their site the day you pay.
