Trader tax status checker

Compare a year of your trading with the IRS's conditions for trader tax status and the benchmarks advisers draw from Tax Court cases.

Updated 25 October 2026. Runs in your browser; nothing you type is uploaded.

Example yearExample meets all three benchmarks

Count each opening and each closing trade.

Days with at least one trade, this year or last.

About 250 a year for US stocks.

From entry to exit, averaged over your trades.

Research and execution; no published threshold.

Do you trade for daily price moves, not dividends or long-term growth?

Did you trade in every month?

Against the IRS conditions and the advisers' benchmarks

5 of 5 met

Your activity meets every benchmark trader-tax advisers use. The IRS still decides on all the facts.

  • Aim: profit from daily movesYes · benchmark Required (IRS)
  • Trades a year860 · benchmark 720+
  • Days traded82% of market days · benchmark 75%+
  • Average holding period3 days · benchmark 31 days or less
  • Trading in every monthYes · benchmark Continuity (IRS)

The line marks each benchmark. With trader status, a section 475(f) mark-to-market election for 2027 is due by Thursday, April 15, 2027; under it the wash sale rule and the $3,000 capital loss limit no longer apply to your trading securities. Not tax advice: an election is hard to undo.

The math: trader = profits from daily moves + substantial activity + continuity and regularity (IRS Topic 429)

The IRS's three conditions

Profit from daily moves, substantial activity, continuity and regularity: all three, weighed on four facts.

Topic no. 429, in its words

"You must seek to profit from daily market movements in the prices of securities and not from dividends, interest, or capital appreciation; your activity must be substantial; and you must carry on the activity with continuity and regularity." The facts weighed: typical holding periods; the frequency and dollar amount of your trades; the extent to which you pursue the activity to produce income for a livelihood; and the time you devote (IRS Topic no. 429, reviewed 24 September 2026).

The benchmarks, and the cases behind them

Numbers advisers use; the law names none.

The benchmarks as Robert A. Green, CPA, of Green Trader Tax presents them in a 2021 webinar for Interactive Brokers (read 25 October 2026). They are guideposts for judgement: courts have denied trader status to people above some of them and granted it on the whole picture.

The section 475(f) election deadline

By the original due date of the prior year's return, without extensions; late elections generally aren't allowed.

What the election changes

With trader status and a timely election, gains and losses on your trading securities are ordinary, reported on Form 4797, and the wash sale rules and the capital loss limits don't apply to them; securities held for investment stay outside it and must be identified the day you buy them (IRS Topic no. 429). Losses you can't deduct under the wash sale rule today are what the election removes. Not tax advice: the election is hard to undo.

Method and privacy

Method: The IRS conditions and factors are Topic no. 429's (reviewed 24 September 2026). The numbers are practitioners' benchmarks as Green Trader Tax publishes them: about 720 trades a year (Poppe v. Commissioner, T.C. Memo. 2015-205), trading on about 75% of market days, and an average holding period of 31 days or less (Endicott v. Commissioner, T.C. Memo. 2013-199). Not tax advice.

A link with your numbers carries them after the # sign, which browsers do not send to servers, and the page takes them out of the address before any analytics loads. Common questions

What is trader tax status?

The IRS treats trading for your own account as a business when you seek to profit from daily market movements rather than dividends, interest or capital appreciation, your activity is substantial, and you carry it on with continuity and regularity. It weighs typical holding periods, the frequency and dollar amount of trades, whether the activity produces income for a livelihood, and the time devoted (IRS Topic no. 429). Traders report business expenses on Schedule C.

How many trades do you need for trader tax status?

No number is in the law. Advisers use about 720 trades a year, counting each opening and each closing trade, from the Poppe Tax Court case (T.C. Memo. 2015-205), with trading on about 75% of market days and an average holding period of 31 days or less, as discussed in Endicott (T.C. Memo. 2013-199).

What is the deadline for the section 475(f) mark-to-market election?

The original due date, without extensions, of the prior year's return: for the 2027 tax year, 15 April 2027, with the statement attached to your 2026 return or to its extension request. A new taxpayer who didn't have to file the prior year places the statement in their books within 2 months and 15 days of the year's start. Late elections generally aren't allowed (IRS Topic no. 429).

Does trader tax status get rid of the wash sale rule?

Not on its own. With trader status and a timely 475(f) election, gains and losses on your trading securities are ordinary, and the wash sale rules and the capital loss limits don't apply to them (IRS Topic no. 429). Without the election, both still apply.

Can a part-time trader have trader tax status?

The IRS's test doesn't require trading to be your only work: it asks whether your activity is substantial, continuous and regular, and weighs the time you devote. Courts have denied the status where trading was sporadic or holding periods were long, which is what the benchmarks on this page measure.

These tools calculate from your inputs, supported historical records or explicitly labelled teaching examples. They do not verify a live account, predict future returns or confirm that a broker or prop-firm rule has been met. Missing costs, floating losses and changed market conditions can materially change outcomes. Trading can lose the capital committed to it; check the stated method and your account specifications.
